MPT, Inc. ("MPT", the “Company", "we", "us") provides technology used by merchants wishing to adopt a multipricing program including, without limitation, digital pricing display services, payment repricing display services, and other associated products and services, however accessed (collectively “Services”). Consumers and businesses that consider purchasing goods or services from such merchants (“Customers”) may also use the Services as part of their shopping and/or purchasing activities. Accordingly, this privacy policy (“Privacy Policy”) addresses merchants, Customers, and any other person who discloses Personal Information (as defined below) while directly or indirectly using the Services, visiting our website (the “Site”), registering for and/or using any mobile application we may make available (“App”), communicating with us regarding customer service inquiries, or engaging in any other interaction with us. Personal information is any information or data relating to you that may be used to identify you, either directly or indirectly, or to contact you (“Personal Information”).

 

Your privacy is important to us. This privacy policy (“Privacy Policy”) details the type of information we may gather from you or that you may provide to us. It also outlines our protocols and procedures related to how we gather, use, safeguard, and share your information and describes the rights you have over your information. By using our Services, visiting our Site, registering for and/or using our App, or otherwise interacting with MPT in any way, you agree to the collection and use of your personal information in accordance with this Privacy Policy. 

 

Some of our Services may be made available to you by our affiliated companies. Personal Information supplied by you through our Services, Site and/or App to our affiliates will be governed by this Privacy Policy.

By using the Services or our Site, registering for and/or using our App, or providing information to us by any other means including, without limitation, in correspondence, you acknowledge that you have read, understood, and consent to be bound by this Privacy Policy.

Changes to this Privacy Policy.    This Privacy Policy was published on the date “Last Updated” above.  The Company reserves the right to modify this Privacy Policy at any time in our sole discretion, so please check back periodically because any information that you submit or we collect from you after a change has been posted will be subject to the modified Privacy Policy. YOUR CONTINUED USE OF OUR SITE OR SERVICES CONSTITUTES YOUR ACCEPTANCE OF THOSE CHANGES.

   2. Information We Collect.   We collect different kinds of Personal Information about you via our Site, in the course of providing Services to you, when you register and/or use our App, or when you otherwise provide us information such as:   

 

• Information about you and your business such as name, phone number, email address, mailing address, and date of birth;

• Information about your purchasing habits, purchasing history, transactions, payment and billing information, geolocation information, ; 

• Information about how you access our Services, our Site, or an APP including information about the device and browser you use, your network connection, your IP address, and details about how you browse and interact with our Services, Site and/or App;

• Customer support information (such as questions and issues) and general feedback that you choose to provide; 

• Information (such as demographic information) we receive from other third parties, including referral, promotional, and joint marketing partners and business partners who provide complementary services or products to our Services; and/or

How We Use Your Information.   We use your Personal Information to provide, enhance, and personalize our Services, the Site and/or App, to fulfill a contractual obligation,  or where we need your Personal Information for other legitimate business interests, including to better understand business trends, Customer purchasing preferences, how our Services, Site and/or App are used, and share these insights with our affiliates and business partners. Aggregate and Non-Personal Information.   MPT may use Personal Information in aggregated or de-identified form, so that it is no longer reasonably associated with an identified or identifiable natural person, for any business purpose. Aggregated data is derived from your personal data but is considered non-personal data under the law, as it does not directly or indirectly disclose your identity. For example, we may analyze your Services usage information in an aggregated form to determine the percentage of users accessing specific features. Such aggregated information is not considered Personal Information for purposes of this Privacy Policy and we may use it for any purpose, including but not limited to, for our internal uses, research and general marketing purposes, such as generating statistics, developing plans for promoting our Services and to better understand the audience utilizing our Services, the Site and/or an App. We may also collect certain non-personal information about your use of our Services, the Site and/or an App (e.g., to determine which pages of our Site are most popular and to improve use of the Site). We may collect IP addresses to analyze trends, administer our Services, Site and/or App, track traffic patterns, and gather demographic information for aggregate use. We may share this aggregated non-personal information with our affiliates, licensees and partners, and may post analyses and statistics based on the aggregated data on the Site or elsewhere, or use the data for research or promotional purposes relating to our mission.

 

      5. Cookies and Web Beacons.   Our Site and/or App may utilize technologies such as cookies or web beacons as part of its functionality. These mechanisms are implemented with the sole purpose of aggregating and analyzing data related to the pages visited by our users. This data allows us to gain crucial insights into user behavior and preferences, which in turn, guide our decisions when updating, redesigning or enhancing our Site and/or App. The objective behind these improvements is to consistently provide you, our valued user, with a more relevant, streamlined, and useful browsing experience. Importantly, while cookies and web beacons do provide us with valuable data, they do not automatically lead to the collection of Personal Information. They primarily allow us to gauge Site and App usage patterns, which aid in the overall enhancement of our Services. Your Personal Information, such as your email address, is treated separately and with utmost respect for your privacy. We only collect this type of Personal Information when you voluntarily provide it to us, for instance, when creating an account, registering in an App, or making a purchase. This distinction underlines our commitment to protecting your privacy while still enabling us to improve our Services offerings.

Disclosure of Your Information.   We routinely share your Personal Information with our affiliates, service providers we use to help deliver our Services, Site and App, and with other third parties we use to help us run our business, such as marketing agencies or website hosts.  We will share your Personal Information to comply with our legal obligations. This could include responding to court orders or other lawful requests, adhering to regulations or legal processes, or as required by law enforcement or regulatory authorities. It is our responsibility as a business to abide by these legal requirements. We may need to share your Personal Information to enforce or apply our Terms of Service and other agreements. This means if there is a breach of our agreement or a dispute regarding the interpretation of our terms, your Personal Information may be disclosed as part of the dispute and resolution process. In these situations, we typically anonymize information, but this may not always be possible.  The recipient of the information in these situations will be bound by confidentiality obligations.  

 

      7. Your Rights Regarding Your Information.   To the extent required or permitted by applicable law, you have the right to: 

 

• Access your Personal Information; 

• Be informed about how your Personal Information is being used; 

• Request correction or erasure of your Personal Information;

• Object to the processing of your Personal Information;

• Request transfer of your Personal Information to you or a third party; and

• Withdraw consent to the use of your Personal Information. This won’t affect the lawfulness of any processing carried out before you withdraw your consent.

 

Please note: We are not obligated to correct, update, or delete your Personal Information if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf.

 

      8. Data Security.   Providing security for the Personal Information that you submit is a top priority. We use generally accepted industry standards to protect the Personal Information we collect, both during transmission and once we receive it. We endeavor to protect the Personal Information we receive, gather and store, by such means as encryption, access control procedures, network firewalls, physical security, and other measures intended to protect the information that you provide to us.  These measures increase the security and privacy of information traveling to, from, and within Company. Please be aware, however, that no physical or electronic security system is impenetrable.  We cannot guarantee the security of our servers or databases, nor can we guarantee that the Personal Information you supply to us will not be intercepted during transmission over the internet. Any such transmission of information by you over the internet is at your own risk. We will maintain a record of every breach of security safeguards involving Personal Information under our control. We will notify you of any breach of our security safeguards involving your Personal Information if it is reasonable in the circumstances to believe that the breach creates a real risk of significant harm to you and as may be required by law.

 

        9. Data Retention.   We retain your Personal Information as long as necessary for the purposes for which it was collected, including to satisfy any legal, regulatory, tax, accounting, or reporting requirements. Criteria include the duration of our relationship with you, legal obligations, and operational requirements.

Children’s Privacy.   Our Site and App are not directed to children and we will not knowingly allow anyone under the age of 13 to use the Site or App or to provide us with any Personal Information. Children always should get permission from their parents before sending any information about themselves (such as their names, email addresses and phone numbers) over the Internet. If you are under 13, please do not use our Services, access the Site or App, or provide any information about yourself. If a child under 13 submits Personal Information to us and we learn that the Personal Information is the information of a child under 13, we will, in compliance with the Children’s Online Privacy Protection Act, delete the information as soon as possible and cancel the corresponding accounts.          11. Links To Other Websites.   Our Services, Site, and/or App may contain links to third party websites, products, or services that we do not own or operate. When you click on a link to any other website or product or service location, you will leave our Services, Site, or App and go to another site, and another entity may collect Personal Information or anonymous data from you. We have no control over, do not review, and cannot be responsible for, these third party websites, product or service links, or their content. As such, we urge that you exercise caution before providing them with your Personal Information. Please be aware that the terms of this Privacy Policy do not apply to these third party websites, product or service links, or content or to any collection of your Personal Information after you click on such third party links. We encourage you to read the privacy policies of every website or other linked location you visit.          13. California Privacy Policy. This section applies to individuals residing in California.

We collect limited Personal Information from or about California users as described in the "Information We Collect" section of this Privacy Policy. This may include identifiers (such as name and email address), commercial information (such as transaction records), internet activity (such as device or browsing data), and other information necessary to provide and improve our Services. We use this information for the purposes described in the "How We Use Your Information" section, such as to operate our services, communicate with you, and comply with legal obligations. We do not sell your Personal Information. We also do not use or disclose sensitive Personal Information for purposes other than those reasonably necessary to provide our Services or as permitted by law.
